Could you telll me whether it is a criminal offence to destroy or make unavailable somebody's will. I know that my parents will existed and where it was kept. if someone has removed it and claim never to have known about it, what are the consequences@

I also support the position that everyone should have a power of attorney. I run a will writing and estate planning company and we encourage everyone who writes a will to also do an Enduring Power of Attorney (EPA).

In the UK it is going to get slightly more complicated to get an power of attorney from next year, changes in the mental health act means an Enduring power of attorney changes to a lasting power of attorney. In order to get the new lasting power of attorney it seems you will need to have a doctors certificate certifying your mental state. This at very least is going to make it more time consuming, expensive and difficult to get a power of attorney in place. I would therefore urgently urge UK based people to put in the EPA whilst this can still be done without the need to trouble your doctor, many companies like my own can arrange these for. It is relatively cheap and can be done as part of producing your will, or as a standalone activity.
